Oklahoma court rejects ultrasound abortion law

OKLAHOMA CITY ? An Oklahoma judge has permanently blocked a state law that requires women seeking abortions to have an ultrasound and listen to a detailed description of the fetus before the procedure.

District Judge Brian Dixon handed down an order Wednesday ruling that the law is unconstitutional and unenforceable. The order says the statute passed in 2010 is an unconstitutional special law because it addresses only patients and physicians concerning abortions and not other medical care.

Enforcement of the law had been blocked since shortly after Nova Health Systems, operator of Reproductive Services of Tulsa, challenged its constitutionality in May 2010. It would have forced a woman seeking an abortion to undergo an ultrasound, have the image placed in front of her and then hear it described in detail.


It was unclear whether?an appeal would be filed.

The author of the ultrasound statute, Rep. Lisa Billy, R-Lindsay, said she was disappointed with the ruling.

"I think women deserve to have all the information necessary before making that decision," Billy said.

Here's how abortion measures are faring in other states:

Arizona
A controversial bill that proposes to ban most abortions performed after 20 weeks of pregnancy moved closer to becoming law in the Republican-controlled state Legislature after clearing the state Senate.

The bill, which would still allow abortions after 20 weeks in the case of medical emergency, was passed by a mostly party-line 20-10 vote in the Senate on Tuesday. Only a small number of abortions are performed in Arizona after 20 weeks.

State Rep. Kimberly Yee, a Republican who sponsored the bill, said she has the votes needed for the late-term abortion bill to pass the House and head to Arizona Gov. Jan Brewer to sign.?No vote has yet been scheduled, and Brewer, a Republican, has not indicated whether she would sign such a measure.

Idaho
The Republican-controlled Legislature this week backed away from a bill requiring women seeking an abortion to get an ultrasound first, capping weeks of contentious Capitol demonstrations and threats against at least one lawmaker.

The legislation passed the Senate, but stalled in the state House after Rep. Tom Loertscher, a Republican from Iona and?chairman of the House Affairs Committee,?said Tuesday that he wouldn't schedule a committee hearing.

Tennessee
A bill in the Tennessee Legislature that included the online publication of the names of doctors who perform abortions was withdrawn amid a flurry of controversy last week.

Also withdrawn was?a requirement?to post statistical information about women who undergo the abortions. Critics said it had the potential to inadvertently identify women who've had an abortion. The bill now says that doctors who perform abortions in the state must have hospital privileges in local hospitals.

Emphysema detected on computed tomography and risk of lung cancer: A systematic review and meta-analysis.

Abstract

BACKGROUND:

Studies exploring the association between emphysema detected on chest computed tomography (CT) and lung cancer have yielded mixed results. Our objective was to systematically review the evidence for this association.

METHODS:

We searched MEDLINE, EMBASE and the Cochrane Library for the terms "lung cancer", "emphysema" and "computed tomography" without language restriction. Bibliographies were also reviewed and authors contacted for additional information. Human studies in which CTs were performed and assessed for emphysema and in which subjects were evaluated systematically for lung cancer were included. Qualitative synthesis of evidence was performed followed by pooling of effect estimates using a random-effects model.

RESULTS:

Of 187 citations, 7 were included in the qualitative synthesis and 5 in the meta-analysis. Three studies assessing emphysema visually observed an association with lung cancer, independent of smoking history and airflow obstruction. Three studies using densitometry to detect emphysema found no association with lung cancer. Another study directly comparing automated and visual emphysema detection techniques found only the latter to associate with lung cancer. Among 7368 subjects included in the meta-analysis, 2809 had emphysema on CT and 870 were diagnosed with lung cancer. The pooled adjusted odds ratio for lung cancer in the presence of emphysema on CT was 2.11 (95% CI 1.10-4.04); stratification by detection method yielded OR of 3.50 (95% CI 2.71-4.51) with visually detected emphysema and 1.16 (95% CI 0.48-2.81) with densitometric emphysema.

CONCLUSION:

Systematic literature review shows emphysema detected visually on CT to be independently associated with increased odds of lung cancer. This association did not hold with automated emphysema detection.

Meek Mill, Wale Aim To Bring Hometown Vibes To Self Made, Vol. 2

There are quite a few things that fans can expect to hear on Maybach Music Group's upcoming Self Made, Vol. 2 compilation album. Chances are we'll hear the infamous "M-M-Maybach Music " drop a number of times, a few of Rick Ross' patented grunts and, according to Wale and Meek Mill, a bit of their respective hometown vibes.

"Me and Wale, we always talk all the time, and I told Wale I actually wanted to do a couple myself on a Philly type of vibe and he wanted to do something on a D.C. type of vibe," Meek told MTV News from the video set for the new MMG single "Bag of Money" featuring T-Pain.

The first Self Made album boasted a number of successful singles like Meek Mill's "I'ma Boss" and Wale's "That Way." Each member of the roster contributes solo songs, while the others pitch in on the feature side. For example, Self Made, Vol. 2's first single, "Bag of Money," is billed as a Wale single, though Meek Mill and MMG boss Rick Ross both contribute. Though Wale and Meek have their own plans to put on for their respective cities, Meek makes note that in the end, Rozay is the glue that brings it all together.

"Ross is always gonna bring a lot to the table with Self Made. I'ma say he's the ringleader of the whole Self Made movement, so we just wanted to bring our parts of the table to it so we make it..." Meek said, taking a moment searching for the right word until Wale pitched in and helped finish the thought. "Have a definitive sound," he added.

The two MCs estimate that they have close to 40 songs already recorded for the compilation and they weren't quite sure which tracks would make the project. They did, however, promise a diverse sound. "You gonna hear D.C., Philly, the South, everything all in one," Meek said. "We just want to give you a part of everything."

Why Democrats are cheering the Paul Ryan Republican budget plan

As they did last year, Democrats are attacking the Republican budget plan released by Rep. Paul Ryan as an 'end of Medicare as we know it.' They think it will help them in November.

With the budget plan he presented Tuesday, Rep. Paul Ryan (R) of Wisconsin wanted to?draw clean, clear distinctions between how Republicans and Democrats would handle the huge federal deficits now facing the US.

Democrats, however, believe Congressman Ryan has just given them a clean, clear shot at Republican candidates in November. ?

On Tuesday, they were are already lining up to take their swing at what they considered a political pi?ata.?

The primary target, as was the case when House Budget Chairman Ryan released his budget last year, is Medicare. Last year, Ryan's proposals for reforming Medicare became a campaign issue, with one Democratic candidate in upstate New York winning a traditionally Republican seat in a special congressional election by building her message around Republican plans to "end Medicare."

Ryan has softened last year's reforms, even?working with Sen. Ron Wyden (D) of Oregon to give his efforts a bipartisan sheen.

But so far, the Democrats' response to the Ryan plan appears to be a carbon copy of a year ago.

Before Ryan?s budget was even released, the Democratic Congressional Campaign Committee launched a ?Medicare March? initiative, using robocalls to tie 41 GOP lawmakers to the budget.?

?It is still a proposal that creates a voucher system for Medicare and thereby ends Medicare as we know it,? White House spokesman Jay Carney said at his daily briefing on Tuesday. ?Contrary to some assessments that somehow by calling it Medicare it still remains Medicare, we're going to stand by the fact that Medicare as we know it would be ended by this program.?

The problem for Republicans is that, as was the case last year, they've done little to prepare American voters for the plan.?

In 2011, ?there was never any effort on the part of Republicans to sort of sell [the budget] first,? says Jennifer Duffy, senior editor at The Cook Political Report. Noting a similar lack of political preparation work this year, Ms. Duffy adds: ?If it's the same sort of approach, then they hand Democrats a cudgel.?

The Democrats are eager for a cudgel.?

Republicans once bashed President Obama?s health-care reforms, saying they included ?death panels? designed to ration care for the elderly. Democrats are trying to use the Ryan plan to create their own policy bogeyman: the death spiral.?

Russia, China join UN demand for Syria peace move

The UN Security Council demanded Wednesday that Syria immediately implement a peace plan by special envoy Kofi Annan, even as government forces pounded rebel zones around Damascus and Homs.

Russia and China, which have blocked two resolutions on Syria, backed a western-drafted statement that called on President Bashar al-Assad to work toward a cessation of hostilities and a democratic transition. The council gave a veiled warning of future international action.

The presidential statement, which carries less weight than a formal resolution, gives strong backing to a six-point plan that Annan, the UN-Arab League envoy, put to Assad in talks in Damascus this month.

As the statement was read out, Syrian troops rained shells on the Homs district of Khaldiyeh. At least 19 people have been killed in two days of bombardments in Homs and at least 23 across the country on Wednesday alone, activists said.

Thirty-nine bodies were found in the Rifai sector of Homs, activists added. They had probably been killed at the same time as 48 women and children whose mutilated bodies were found on March 12.

There were also fierce clashes between rebels and security forces near an intelligence post in the Damascus suburb of Harasta, according to the Syrian Observatory for Human Rights.

The UN says well over 8,000 people have been killed in Syria in the past year.

The Security Council statement called on Assad and the opposition to work with Annan "towards a peaceful settlement of the Syrian crisis and to implement fully and immediately his initial six-point proposal."

It said Annan should regularly update the council on his efforts. "In the light of these reports, the Security Council will consider further steps as appropriate," the statement adds.

The council gave "full support" to Annan's efforts to set up a Syrian-led transition to a "democratic, plural political system."

Annan has a team of advisers in Damascus determining whether it is possible to take the peace process forward.

The former UN chief was "encouraged by the united support of the Security Council behind his efforts and urges the Syrian authorities to respond positively," his spokesman Ahmad Fawzi said in statement.

The special envoy also sought the release of people detained over the past year of the uprising against Assad.

The mention of a political transition, along with Russia and China's backing for the statement, was a strong signal to the increasingly isolated Assad government, diplomats said.

"This sends precisely the strong and united message to the Syrian government and all other actors in Syria that they need to respond and respond quickly and immediately to the six-point plan," said Britain's UN ambassador Mark Lyall Grant.

In a sign of the new diplomatic urgency over Syria, the Security Council also agreed on a press statement, proposed by Russia, that "condemned in the strongest terms" bomb attacks in Damascus and Aleppo over the weekend.

US Secretary of State Hillary Clinton praised the UN statement and warned Assad to carry out the peace plan or face "increasing pressure."

"To President Assad and his regime, we say, along with the rest of the international community, take this path, commit to it, or face increasing pressure and isolation," Clinton told reporters in Washington.

Beijing urges Syria to "actively support and coordinate the good office of Annan, cease violence immediately, reflect political will and launch political dialogue as soon as possible in order to achieve an early political settlement of the Syrian crisis," China's UN Ambassador Li Baodong told the Xinhua state news agency.

The Russian and Chinese vetoes of recent moves have left the Security Council in deadlock in recent months. But Russia's Foreign Minister Sergei Lavrov welcomed the Security Council's move.

"The document does not contain any ultimatums, threats or assertions about who is guilty," said Lavrov. Russia is Syria's main ally but it has indicated growing impatience with Damascus.

European countries still want to press for a full, binding Security Council resolution on the crisis in Syria, however.

French envoy Gerard Araud called the statement "a small step by the Security Council in the right direction."

"A resolution is still on the table and we hope we will manage to obtain a Security Council resolution," Araud told reporters.

Clashes rock Syrian capital amid insurgency fears

(AP) ? Syrian rebels battled regime forces Monday in a heavily protected, upscale area of Damascus, activists said, in a sign that the country's outgunned opposition is increasingly turning to insurgent tactics.

At least three people were killed in the firefight, which was the most serious clash in the Syrian capital since the uprising began a year ago. The battle with machine guns and automatic rifles brought the country's violent conflict to the streets of a neighborhood that houses embassies and senior government officials.

The Britain-based Syrian Observatory for Human Rights, which has a network of activists throughout the country, said 18 government troops were wounded in the fighting and two later were believed to have died.

Rami Abdul-Rahman, who heads the Observatory, described the clash "as the most violent of its kind and closest to security centers in Damascus since the revolution began."

He said several "armed groups of defectors" came from one of the suburbs and fired a rocket-propelled grenade at the house of an army brigadier general. They then entered a building where they were chased by security forces.

It was not clear whether the general was hurt, he said.

The state-run SANA news agency gave a different version of events, saying the fighting broke out when security forces stormed an apartment used as a hideout by an "armed terrorist" group in the Mazzeh neighborhood.

The report said two gunmen were killed and a third was arrested while a member of the security forces was killed.

Due to restrictions on journalists in Syria, it was impossible to reconcile the two accounts. Since the start of the uprising against President Bashar Assad, the regime has referred to its opponents as terrorists and insisted the revolt is driven by a foreign conspiracy, not popular will.

The uprising began with mostly peaceful protests against the government, inspired by the Arab Spring uprisings across the region. But the regime cracked down violently, opening fire on demonstrations and rounding up thousands of protesters.

Russia, a key Assad ally, said the Syrian government and rebels should halt their fighting once a day to give the Red Cross access to the wounded. The call came after Russian officials met with the International Committee of the Red Cross, which had urged Moscow to take such a stand.

Russia had previously backed the ICRC's call for a cease-fire, but Monday's statement from the Foreign Ministry was worded more strongly than previous ones in an apparent signal that Moscow is raising the pressure on Syria.

A resident of the Mazzeh district of western Damascus said Monday's two-hour clash began with an exchange of fire from automatic rifles and machine guns, and ended about 4 a.m. local time.

"We also heard three strong explosions," said the man, who spoke on condition of anonymity for fear of government reprisal.

He added that the clash was close to the Swiss Embassy and the home of Maj. Gen. Assef Shawkat, the deputy chief of staff for security affairs, who is married to Assad's sister.

Mazzeh is home to affluent Syrians of different sects, and is the first Damascus neighborhood that people coming from Lebanon reach. It is about a mile (two kilometers) from a military airport.

An activist in the capital said the clashes were near the Political Security Directorate building and were followed by raids by security forces.

The rebel Free Syrian Army, which includes thousands of army defectors, has claimed responsibility for attacks against regime forces in the past, but the group's leader, Col. Riad al-Asaad, refused to comment on Monday's fighting.

"This is a sensitive military matter that we cannot comment about," he told The Associated Press by telephone from Turkey, where the movement is based.

Although armed rebels are active in the Damascus suburbs and satellite towns, they rarely venture into the capital, where Assad's troops are deployed in force.

The fighting in Damascus comes after the rebels suffered several major setbacks when they were driven out of strongholds in the northern city of Idlib and the central city of Homs, in part because of the superior firepower from government forces.

Damascus has been largely spared the steady gunfire and killings reported elsewhere in Syria in the past year, although the capital has had several major bombings that targeted government security buildings.

The most recent attack was Saturday, when twin car bombs killed 27 people near the air force intelligence building and the criminal security department.

The bombings in Damascus and Aleppo have added a mysterious element to the anti-government revolt.

U.S. officials have suggested that al-Qaida militants may be joining the fray, perhaps exploiting the chaos.

Assad's military has remained largely intact, making it a formidable opponent for the FSA, the most potent armed group challenging the regime. The FSA has struggled to acquire weapons, saying an influx of arms by foreign countries could help turn the tide.

But few are even considering arming the opposition, out of fear that it would make the conflict worse. Syria has a web of regional allegiances that extend to Iran and the Lebanese militant group Hezbollah, raising concern that violence could spread beyond its borders if other nations directly army the rebels or send in their own troops.

There also are fears of civil war, as the conflict has fed sectarian tensions.

The military's top leadership is stacked heavily with members of the minority Alawite sect, to which Assad and the ruling elite belong. But Sunnis are the majority in the country of 22 million and make up the backbone of the opposition.

Diplomatic efforts to resolve the crisis have so far brought no result.

During a recent visit to Damascus, Annan pushed for an immediate cease-fire to allow all parties to hold a dialogue on a political solution. The government responded in a letter to Annan that it is "keen to end violence" but insisted that rebels give up their weapons first.

The U.N. says more than 8,000 people have been killed in the yearlong uprising, which has deeply polarized a country where the Assad family has ruled for more than 40 years.

Russia has stood by Syria, providing Damascus with weapons even as the U.S., the European Union and others impose arms embargoes on the regime. Both Russia and China have protected Syria from U.N. sanctions, although Moscow recently has shown some signs that it was losing patience with Assad's harsh stance.

Russian Foreign Minister Sergey Lavrov told lawmakers last week that the Syrian leader has been slow to implement long-needed reforms, warning that the conflict could spiral out of control.

He also complained in a weekend interview with Russian state television about the "unproportional" use of force by the government troops and said that Moscow disagrees with many of the decisions made by the Syrian leadership.

"We are supporting the need to start a political process, and to do that it's necessary to have a cease-fire first," Lavrov said. "Russia will do everything for that, irrespective of the decisions made by the Syrian government. We disagree with many of those, by the way."

?When I found out he was from Ft. Lewis,? she told The Daily Beast, ?it didn?t surprise me at all.?

That?s because the base has earned an infamous reputation in recent years for churning out troubled troops. One soldier murdered his wife and stuffed her body into a storage crate after his return from a third deployment in Iraq. Another allegedly set his wife on fire. Another was convicted of waterboarding his own young daughter for failing to know her ABCs. The Afghan kill team that perpetrated a three-month murder spree against innocent Afghan civilians came from Lewis-McChord. The former Army private who shot and killed a National Park Service ranger at Mount Rainier National Park on New Year?s Day was from Lewis-McChord.

Suicides of soldiers from that base totaled 12 in 2011?a base record. Joppa-Hagemann?s husband was one of them. That?s why Sunday?s news was sad but unsurprising. Jared Hagemann killed himself in order to avoid his ninth deployment overseas, his wife said. He just couldn?t go back in again.

?After he came home from his ninth deployment, he called me up, talking about how he had a bottle of pills and a gun,? she said. ?He said he wanted to kill himself or get out of the military.?

Is Lewis-McChord at the root of the 38-year-old staff sergeant?s troubles? At this point, it?s tough to say for sure. The military has yet even to release his name, though sources at the Pentagon and in Congress have confirmed to other media outlets that the soldier has a wife and two children and was indeed stationed at Lewis-McChord.

Lewis-McChord is certainly not the only military base to foster tragedy. In 2009, at Fort Hood, in Killeen, Texas, an Army psychiatrist opened fire on the post, killing 12 and wounding 31. A year before, at the same base, a soldier fatally shot his lieutenant and then killed himself. At Fort Carson, Colorado, 14 soldiers allegedly committed or were charged with murder between 2005 and 2008. Earlier this year, an Army sergeant shot and killed five soldiers at a combat stress center at Fort Liberty in Iraq.

But Joppa-Hagemann and other outspoken critics of the way Lewis-McChord takes care of soldiers say it has become all too common for troops from that base?one of the nation?s largest, with 43,000 soldiers?to fall through the cracks, to have their posttraumatic-stress counseling ignored, and to be redeployed despite obvious signs that they need more help at home.

Joppa-Hagemann says there aren?t enough people helping the many who need it. ?There are just too many to really take care of anyone,? she said. Her husband was a prime example, numbed during his time in Afghanistan. ?This transition within 24 hours of going from killing people and coming home and holding his children, having people call him a hero. Whether it got to the 38-year-old staff sergeant who could face the death penalty for Sunday?s killings is one of many unanswered questions. But what has become clear to many observers at Lewis-McChord is that there?s something wrong.

?This was not just a rogue soldier,? said Jorge Gonzalez, executive director of Coffee Strong, a nonprofit G.I. coffeehouse just outside the base?s gates, in a statement. ?JBLM is a rogue base, with a severe leadership problem. If Ft. Lewis was a college campus, it would have been closed down years ago.?

Last month, the Army removed Col. Dallas W. Homas from his post as commander of the base-affiliated Madigan Army Medical Center after 285 patients diagnosed with posttraumatic-stress disorder had those decisions overturned as they went through a screening process that could have resulted in their retirement from the military, according to Sen. Patty Murray. Which is to say, the center that was supposed to be treating soldiers? posttraumatic stress was actually undiagnosing people, over a five-year period dating back to 2007.

"The only fair thing to do is to go back and find those service members who've also had their PTSD reversed by this unit in order to give them clear and unbiased re-evaluations,? Murray told the Seattle Times. ?Our service members and their families deserve nothing less."

It?s unclear what the rationale was for reversing those patients? diagnoses?or whether the staff sergeant involved in Sunday?s shootings was among them?but the Times found considerable disputes between the military and the Department of Veterans Affairs over how to diagnose PTSD.

Gonzalez and others say the reversals are nothing more than an attempt to reduce treatment costs and keep soldiers available for redeployment.

?This tactic of overturning diagnoses is another cost-cutting measure the military has set up in order to save money,? Gonzalez said, ?after 11 years of the so-called global war on terror.?

Lewis-McChord officials declined to comment Tuesday on either Sunday?s killings or the base?s troubled history, but Lt. Col. Gary Dangerfield told Reuters Monday, ?I don?t think we?re any different from any other base in the military.?

That attitude is part of what?s wrong, said Karrie Champion, whose son Jonathan Gilbert killed himself last July to avoid returning to Afghanistan. Gilbert?s station: Lewis-McChord.

?There is a problem at that base,? she said. ?There?s been a problem for awhile. A congressional investigation is long overdue. Somebody needs to clean house.?

The base?s many critics agree that the main issue is multiple redeployments, with precious little time and counseling in between to help soldiers cope with what they?ve seen.

?You send someone on four or five deployments in a short amount of time, something?s going to happen there that maybe no manner of mental health treatment is going to really resolve,? said Matt Howard, a spokesman for Iraq Veterans Against the War. ?There?s a tendency to say ?Hey, take this medicine,? and when soldiers ask to see a civilian provider in town, they?re looking at a four or five month wait, and get redeployed. If these guys are in the middle of treatment, it?s kind of like taking someone?s cast off when they?re halfway healed.?

Sunday?s killings may help lead to the only outcome that Joppa-Hagemann believes will actually prevent more tragedies for troops from Lewis-McChord and elsewhere: an end to the 10-year war. U.S. officials are reportedly debating a accelerated pullout from Afghanistan despite President Obama?s recent comments in a radio interview that we shouldn?t ?rush to the exits? in the wake of that incident and the burning of Qurans last month.

Leaving Afghanistan for good, Joppa-Hagemann said, is the only thing that will really help.

?You can?t start to help these men and then send them back over,? she said. ?We need to show these soldiers we care about them, and stop sending them. The soldiers know it?s a bullshit war. Everybody knows it.?

(AP) ? Take a trip to the zoo and you can see gorillas are a lot like us. But a new DNA study says we're even more similar than scientists thought.

From the evolutionary family tree, you'd expect our DNA to be the most similar to chimps, our closest relatives. The new work found that's true for the most part, but it also found that a sizable portion of our genome is closer to a gorilla's than to a chimp's.

"The chimpanzee is often cited as 'our closest living relative' and this is certainly true based on total genome sequence, but the gorilla is nearly as close a relative," Owen Lovejoy of Kent State University, who was not part of the project, said in an email.

That agrees with hints from with some smaller previous genetic studies. The latest work deciphered the entire genome of the gorilla, which Lovejoy called "a substantial achievement."

It reveals "a closer connection between our genome and that of the gorilla than was previously appreciated," Richard Gibbs and Jeffrey Rogers of the Baylor College of Medicine wrote in an editorial accompanying the work published in Thursday's issue of the journal Nature.

With the new research, scientists now have complete genetic blueprints of the living great apes ? humans, chimps, gorillas and orangutans ? to compare and gain fresh understanding of how humans evolved and developed key traits such as higher brain function and the ability to walk upright.

Humans and chimps evolved separately since splitting from a common ancestor about 6 million years ago.

The latest study was led by scientists at the Wellcome Trust Sanger Institute, a nonprofit British genome research center. Researchers mapped the DNA of a female gorilla and compared it to the genomes of humans and chimps.

As expected, most of the human genome was closer to the chimp's than to the gorilla's. But in about 15 percent of the genome, human and gorilla resemble each other the most. In another 15 percent, chimp and gorilla DNA are closer to each other than chimp is to human. Both those situations clash with what you'd expect from the evolutionary tree, which says humans and chimps should always be the most similar, the researchers said.

The analysis also found gene variants in gorillas that are harmless to them but are linked to dementia and heart failure in people.

"If we could understand more about why those variants are so harmful in humans but not in gorillas, that would have important" medical implications, said one of the study's authors, Chris Tyler-Smith.

The gorilla genome was cracked using DNA from Kamilah, a 300-pound western lowland gorilla from the San Diego Zoo, which maintains a DNA library of endangered animals. Since the mapping of the human genome in 2001, there was a dash to similarly unravel the genetic codes of other animals, particularly primates. The first complete chimp genome was published in 2005 and the orangutan last year.

Like other great apes, gorilla populations in the forests of central Africa have been dwindling from hunting and disease. In decoding Kamilah's DNA, researchers said they hoped to do the same for the mountain gorilla, which is near extinction.
