Man pleads no contest in burglary of Jobs' home

(AP) ? A California man accused of breaking into Steve Jobs' house and stealing computers and the Apple Inc. co-founder's wallet has pleaded no contest to burglarizing homes across the San Francisco Bay area.

Kariem McFarlin accepted a plea deal and was convicted Wednesday in Santa Clara County Superior Court on eight felony counts of residential burglary and one felony count of selling stolen property.

McFarlin was initially charged in August with one count each of residential burglary and selling stolen property after Jobs' Palo Alto home was broken into in July. He apparently didn't realize he was in Jobs' house until he saw a letter addressed to the Silicon Valley icon, who died in October 2011.

During the 15-hour overnight heist, McFarlin took the late Jobs' wallet and driver's license as well as iPhones, iPads, iPods, Mac computers, champagne and $60,000 worth of Tiffany & Co. jewelry, police said.

A stolen iPad ended up in the hands of Kenny the Clown, a well-known street performer who used it to play music during his acts before police came for it.

Police say the clown, whose real name is Kenneth Kahn, didn't know the iPad was stolen when his friend McFarlin gave it to him to repay a debt. The device was returned to Jobs' family.

Investigators from a task force eventually linked McFarlin, 35, to seven other burglaries in Alameda, Marin and San Francisco dating back to March 2011, the San Jose Mercury News reported (http://bit.ly/TcJ30 ).

Prosecutors in those other counties agreed to resolve all of the burglary cases in Santa Clara County, said Deputy District Attorney Thomas Flattery, who filed an amended criminal complaint Wednesday.

"I think it's a good outcome," Flattery said about McFarlin's no contest plea. "I think the case demonstrates a couple of things. Really, it's a good example of judicial economy and cooperation between the various counties to resolve everything at once.

"And it's also an example of the work a multi-jurisdictional task force can do to bring them all together."

McFarlin could face up to seven years and eight months in prison when he's scheduled for sentencing Jan. 17.

He could have received a maximum of 16 years and four months behind bars, but Judge Thang Nguyen Barrett offered to cap the sentence at seven years and eight months in exchange for McFarlin's no contest plea, Flattery said.

Police previously said the Alameda resident confessed to breaking into Jobs' home.

Update on Annotated Legal Cases of International Criminal Tribunals

Annotated Leading Cases of International Criminal Tribunals is a subscription resource that provides commentary and the full-text of selected decisions (including concurring, separate, and dissenting opinions) from the International Criminal Court (ICC) and others including: International Criminal Tribunal for Yugoslavia (ICTY), the International Criminal Tribunal for Rwanda (ICTR), the Special Court for Sierra Leone, the International Criminal Tribunal for Timor-Leste.

This resource is now available for Law School campus access only, meaning access is restricted to the School of Law building limited IP-addresses. Only IP addresses for wired faceplates in the School of Law building provide access. Thus, students may only access this resource via the Lab, Room 321 computers, student organization offices wired computers and the Law Library?s workstations. Annotated Leading Cases no longer works with a login and password, nor via Case Wireless. The reason: Case Wireless? IP addresses are shared campus-wide. There is no set of Case Wireless IP addresses restricted to Law School access only.

More significantly, the database provider?s rather restrictive standard license agreement totally prohibits remote access, whether through a VPN system like Case?s, a proxy server or other remote access.

Reports that controversial right-wing leader Bal Thackeray was critically ill put Mumbai on tense hold for much of Thursday while raising questions about the future of his party, the Shiv Sena, which controls the city government and is an important member of India?s opposition group, the BJP-led National Democratic Alliance.

Parts of Mumbai reportedly shut down Thursday in anticipation of trouble from Sainiks, as the members of his party are known, gathered in large numbers near the residence of the Thackerays. By evening, the 86-year-old?s condition was reported to be stable and a parade of the city?s powerful and famous was visiting the leader?s home amid tight security.?

Thackeray's declining health is putting the spotlight on the fragile state of his party,?which has been riddled by succession struggles for more than a decade and has seemed unable to move beyond its founder?s polarizing identity politics.?

In the four decades of its existence, the Shiv Sena has targeted ??sometimes violently???south Indian migrants to the city, Muslims, so-called symbols of?Western culture like Valentine?s Day, and more recently, north Indian migrants. Earlier this month, Mr. Thackeray reiterated his opposition to cricket matches between the Indian and Pakistani teams in a front-page editorial in the party newspaper,?Saamna, asking party activists to stop such matches from being held in the country.

A political cartoonist known for his barbed rhetoric, Mr. Thackeray formed the Shiv Sena (Shiva?s Army) in the 1960s in the wake of the successful movement for the formation of the state of Maharashtra with Mumbai as its capital. Not unlike Tammany Hall in New York, the Sena promoted the interests of local Maharashtrians or ?sons of the soil? against the influx of migrant workers to Mumbai, historically India?s most cosmopolitan city and its commercial headquarters, through a network of street cadres.

The Sena?s power grew in the 1970s and 1980s, at the expense of the Communists. Thackeray?s invocation of a proud, native identity especially through the historical figure of Shivaji, a 17th century Hindu Maratha warrior who fought the Muslim Mughals and established a Hindu kingdom, found resonance with disaffected young men at a time of declining industrial jobs. During the ?80s and ?90s, the party members? rough-and-ready tactics gave Thackeray the power to shut down the city.

Pakistan: Malala's wounded friends back in school

MINGORA, Pakistan (AP) ? For one month the dreams kept coming. The voice, the shots, the blood. Her friend Malala slumped over.

Shazia Ramazan, 13, who was wounded by the same Taliban gunman who shot her friend Malala Yousufzai, returned home last week after a month in a hospital, where she had to relearn how to use her left arm and hand. Memories of the Taliban bullets that ripped into her remain, but she is welcoming the future.

"For a long time it seemed fear was in my heart. I couldn't stop it," she said. "But now I am not afraid," she added, self-consciously rubbing her left hand where a bullet pierced straight through just below the thumb.

Now Shazia and her friend Kainat Riaz, who was also shot, return to school for the first time since the Oct. 8 attack when a Taliban gunman opened fire on Malala outside the Khushal School for Girls, wounding Shazia and Kainat in the frenzy of bullets.

The Taliban targeted Malala because of her outspoken and relentless objection to the group's regressive interpretation of Islam that keeps women at home and bars girls from school.

Malala is still undergoing treatment and unable to come back. But among her friends in her hometown of Mingora in the idyllic Swat Valley, she is a hero.

"Malala was very brave and she was always friendly with everyone. We are proud of her," said the 16-year-old Kainat, wrapped in a large purple shawl and sitting on a traditional rope bed. Her mother Manawar, a health worker, sat by her side, praised her daughter's bravery and with a smile said: "She gets her courage from me." Although conservative and refusing to have her picture taken, Kainat's mother slammed attacks on girls' education and warned Pakistan will fail if girls are not educated.

Quick to laugh, Kainat ? who comes from a long line of educators in her family ? looked forward to returning to school. "I want to study. I am not afraid," she said.

The authorities however are not taking any chances. Armed policemen have been deployed to both Shazia's and Kainat's home and will escort them both to school.

Kainat's home is hidden behind high walls with 8- foot-high steel gates, tucked away in a neighborhood of brown square cement buildings. A foul smelling sewer runs the length of the street where armed policemen patrol, eyeing everyone suspiciously.

Outside Shazia's home, a policeman wearing a bullet proof vest sits on a plastic garden chair with a Kalashnikov resting across his knees. Three policemen patrol a nearby narrow street that is flanked by roaring open fires where vats of hot oil boil and sticky sweets are made and sold.

Shazia, who has ambitions to become an army doctor, is a stubborn teenager. She doesn't want the police escort.

"They say I need the police. But I say I don't need any police," she said, pushing her glasses firmly back on her nose. "I don't want the police to come with me to school because then I will stand out from the other students. But I shouldn't."

At their school, the students are quick to attack the Taliban and display a giant poster of Malala. The school, which has more than 500 students, only closed its doors briefly at the height of the Taliban's hold on the region in 2008 and early 2009. It was then that Malala began to blog, recording her unhappiness with Taliban edicts ordering girls out of school.

Although she was barely 9 years old then, Shazia remembers those days.

"Times were very bad. Girls were hiding their books under their burqas. Compared to then, now is a very good time," she said, her pink shawl covering her head. "We are strong."

Both the army and the police are deployed outside the school, whose name means "happy," and journalists were not permitted to pass its black iron gate until last week when an Associated Press reporter and photographer were allowed inside. Authorities feared drawing attention, but the students within seemed unconcerned, often offering words of support for Malala and saying they weren't afraid to come to school.

Even the shiest among them would whisper in a friend's ear to say: "Tell her I will not stop studying."

Each morning the school principal gave the students a progress report on Malala's condition.

"She is getting better every day and she asks about all of us and what we are doing," said 15-year-old Mahnoor, one of Malala's close friends. "When it happened we just cried and prayed. We weren't worried for ourselves. We were just worried for her."

Twelve-year-old Emar said of the Taliban: "They are thinking that she is a girl and she cannot do anything. They are thinking that only boys can do things. They are wrong. Girls can do anything."

In a strong voice and speaking in English, Gulranga Ali, 17, said students have "gotten courage from her (Malala) and everyone is attending school. No one is staying home." She said the attack has turned the country against extremists and "now every girl and child is saying 'I want to be Malala.'"

Malala's father says the family will return to Pakistan after his daughter is well enough.

But even her classmates worry for her safety.

"I don't think she will come for education anymore in Swat. She will not be safe here. Now she is a celebrity," said Gulranga.

There is also a deepening concern that Malala's attacker has not been arrested, that the outrage her shooting generated throughout Pakistan has subsided without substantive changes and that fear will prevent real change.

Ahmed Saeed, a close friend of Malala's father, said politicians and Pakistan's military establishment still have to decide if they will support Malala's worldview or that of the Taliban. Saeed said the teenager will have another operation in three months to reconstruct her skull but that she is talking and walking "and gossiping with her family."

In what has been cheered as a first step toward compulsory education for both boys and girls in Pakistan, Parliament last week introduced legislation making it a crime to keep a child at home. Offending parents can be fined upward of $500.

Still, earlier this month the Taliban attacked on a busload of girls returning from school in the tribal regions, throwing acid in their faces. In a statement, the Taliban accused the girls of embracing the West through education.

"I don't know if this has changed Pakistan," Shazia's father said of the shooting. Still, he wants his daughter to continue at school.

"Now I want to be an example to other girls," Shazia said. "They (Taliban) can't stop us from going to school."

Illegal Plumbing Products in Minnesota | Structure Tech Home ...

Home inspectors might find more hack repairs when it comes to plumbing projects than anything else ? mostly because it?s easy to ?do a plumbing project wrong, but still have the drains work. ? Sort of.

I have about a million photos of hack plumbing repairs, but that?s not the point of this post. ?Today I?m going to give a list of some common plumbing products sold at home improvement stores and hardware stores in Minnesota that probably shouldn?t be purchased. ?Whatever you plan to do with these products is most likely going to be a violation of the Minnesota State Plumbing Code.

S-Traps

First and foremost comes my favorite; the drain tube meant for an S-trap or washing machine drain. ?I love the photo below because the packaging encourages you to be your own plumber? which is exactly what the ambitious-looking square on the cover has decided to be, unfortunately. ?He?s installing an S-trap, which is illegal in Minnesota (4715.0960), and as far as I know, everywhere else in the country. ?While the packaging also says that this 1-1/2? drain tube can be used for a washing machine drain, the minimum size allowed for a washing machine drain, also known as a standpipe, is 2? (4715.2300).

Be your own plumber

bottom note: what?s with the suggestion to be your own plumber? Has this clever marketing piece ever actually encouraged someone to ?be their own plumber? ? By the time you?ve wandered in to the plumbing repair aisle at the home improvement store, there?s a good chance that you?ve already made the decision to be your own plumber.

S-traps are usually found at sinks, and are often accompanied by several other plumbing defects.

There is no simple solution to an ?S? trap, but they?re usually not a major problem.

Bottle Traps

Another illegal plumbing trap is any type that relies on concealed partitions to create a trap ? such as a bottle trap (4715.0960). ?They come in several varieties.

The proper and prudent product to purchase in these particular cases is a P-trap.

Corrugated / flexible traps

Corrugated drains have to be one of the most common ?handyman? plumbing repairs that home inspectors find.

These things violate a basic plumbing principal of the Minnesota State Plumbing Code ? section F, which states

?F. The drainage system shall be designed, constructed, and maintained to conduct the waste?water with velocities which will prevent fouling, deposition of solids, and clogging.? ?(4715.0200)

All of those little corrugations allow for fouling, deposition of solids, and clogging. ?When changes in direction need to happen, it should be done with proper fittings that have smooth interiors.

Needle valves / saddle valves

Saddle valves are usually used for whole house humidifiers, which I?m not a fan of to start with, and ice-makers. ?They work by piercing a hole in your water pipe, and they?re prone to leaking. ?They?re also not allowed in Minnesota.

Instead of using a saddle valve, have a proper valve installed.

Clamshell toilet fill valves

Toilet fill valves are supposed to be installed with the critical level line at least 1? above the top of the overflow tube in the toilet tank. ?One of the more common types of fill valves are the ones made by Fluidmaster. ?The diagram below comes from their installation instructions, and it shows what a fill valve should look like.

The toilet fill valves that sit in the bottom of your toilet tank are often referred to as ?clamshell? fill valves, and they?re not allowed in Minnesota, because they create a potential cross-connection between the water in the toilet tank and the potable water supply. Don?t put these in. ?See 4715.2150 ? flush tanks.

Instead of buying a ?clamshell? style fill valve, get the adjustable 400A valve made by Fluidmaster. ?These are sold everywhere.

Rubber fittings

Rubber fittings used on drains or vents like the one shown below can sag or collapse. ?They?re always a no-no.

If you can?t figure out how to make your drains work without the use of rubber fittings, call a plumber.

The one exception to this for above-ground drain and vent piping is a rubber coupler with a stainless steel metal band or sleave surrounding it. ?The stainless steel band gives it rigidity, which prevents what?s happening to the un-banded connector in the photo below.

These un-banded couplers are sometimes allowed or even required on high-efficiency furnace vents, and they?re allowed to be installed on their side when buried in dirt, but the other 99% of the ones you?ll see are wrong. ?The photo below shows a proper steel-banded connector. ?Check out the fine print that says ?2? CI, PL, or ST to 2? CI, PL, or ST?. ?This tells you the different materials that this connector is designed for. ?These types of connectors are usually the right ones to buy.

Slang terms: Note the brand on the coupler shown above ? ?Fernco?. ?When you hear people refer to ?Fernco? couplings, they?re usually referring to couplings?without metal bands, but Fernco obviously makes both. ?When you hear people mention ?Mission? couplings, they?re usually referring to banded couplings? but Mission makes both as well. ?For quick proof of this, do a google image search for ?mission coupling?, and do another for ?fernco coupling?.

Flexible connectors

Flexible connectors aren?t allowed at water heaters or water softeners in Minnesota. ?I?ve heard that these are actually a good thing to use in parts of the country that are subject to earthquakes, but not here. ?The state plumbing code doesn?t allow these flexible connectors, because they reduce the water pipe diameter ? the minimum allowable pipe diameter is 3/4?. ?I know of one manufacturer that offers a connector with a .72? inside diameter, but they?re still not allowed in Minnesota.

I have these connectors installed at my own water heater because that?s what was there when I bought my house. ?I could personally care less if they?re there or not, because I?ve never noticed any difference in water flow at homes that have these? but they?re still a plumbing code violation in Minnesota.

If you have a Truth-In-Sale of Housing Evaluation performed at your home in Minneapolis and the water heater is less than three years old, these flexible connectors would be a required repair item.

Mechanical vents

Mechanical vents are not allowed in Minnesota. ?These are often referred to as cheater vents, and they come in two varieties ? an air admittance valve and a check vent. ?A discussion of the different types is a moot point for Minnesota, because neither is allowed. ?If you?re curious though, check out this post by Seattle Home Inspector Charles Buell on check vents vs. air admittance valves.

The photo below shows a check valve installed on a lav vent inside a cabinet. ?On a proper installation, the vent would have been run inside the wall, connected to other vents for the bathroom, and eventually terminated above the roof.

Cheater Vent

The purpose of a mechanical vent is to allow drains to suck air without admitting sewer gas in to the home. ?I?ve heard that air admittance valves actually work quite well, but they?re still a code violation here in Minnesota.

Just because they sell it doesn?t mean it?s legal. ?I often hear homeowners say ?If these things aren?t allowed in Minnesota, why?d the guy at the store sell it to me?? ?The answer is usually that they didn?t know any better. ?You shouldn?t expect the person working in the plumbing department at a home improvement store to be up-to-date on the latest plumbing codes. ?Plumbers need a lot of training and experience ? that?s why they charge what they do.
