Mexico quashes Frenchwoman's kidnap charge after seven years in jail

MEXICO CITY (Reuters) - Mexico's top court freed a Frenchwoman convicted of kidnapping on Wednesday, ruling that her trial was tainted and ending a seven-year imprisonment that strained ties with France.

Florence Cassez, 38, was sentenced to 60 years in prison after she was arrested in 2005 at a ranch near Mexico City with her former boyfriend, who led a kidnapping gang called the Zodiacs.

Supreme Court Judge Jorge Pardo ordered her release during a televised court session, which at one point looked to be going against Cassez.

Hours later, she was whisked from a Mexico City prison in a vehicle flanked by police trucks to the capital's international airport where she was put on an Air France plane back home.

Cassez, who had maintained she was innocent, and her father were both pictured wearing black flak jackets as they left the prison.

"It's an explosion of joy. It's wonderful," Charlotte Cassez, her mother, told French television.

"It's not far from being the best day of my life. We've been waiting for so long. She deserves it. She is innocent and has fought to prove that. It's a victory for her."

The French government had sharply criticized Mexico for its treatment of Cassez and welcomed her release on Wednesday.

Outside the Mexican prison, however, relatives of kidnap victims wept as Cassez was freed.

"She's out, she's out," cried Michelle Valadez, who accused Cassez of being involved in her husband's kidnapping and screamed "murderer" as she lunged at the vehicle. "What about us?" she asked on local television.

After her arrest, police made Cassez take part in a staged scene of officers freeing kidnap victims. She was portrayed as a kidnapper in the re-enacted event, which was aired on national television. Police subsequently admitted wrongdoing.

A judge sentenced her in 2008 following a closed-door trial with no jury, typical of most cases in Mexico.

Her lawyers said Cassez was denied immediate consular assistance when she was arrested and that the evidence of key witnesses should be thrown out. A majority of the Supreme Court judges agreed, without saying she was innocent.

In March, the Supreme Court rejected a bid to release Cassez immediately but opened the door to a review on Wednesday, which had initially been intended to discuss a motion to invalidate some of the evidence used to convict her.

DRAMATIC DENOUEMENT

Cassez's fate appeared to be hanging in the balance for much of the hearing, when a majority of the five-judge panel said they would vote against the wording of Justice Olga Sanchez's proposal to discard testimony against Cassez.

Two judges dismissed Sanchez's motion on the grounds it was too lenient on Cassez, while two others rejected because it did not go far enough, instead arguing she should be released.

Then, in a startling turn of events, Sanchez, the last judge to speak, took up the objections and proposed a modified motion to release the Frenchwoman. Moments later Cassez was declared a free woman after a majority of the panel backed Sanchez's plan.

"It was an incredible somersault," said Luis Angel Benavides, a penal law professor at Mexico City's ITAM university. "It was a very complicated process and this session was utterly bizarre."

Critics of Mexican justice saw the Cassez case as a test of the system's ability to rectify its faults. But her release also stirred resentment among kidnapping victims. Thousands of serious crimes have gone unpunished by Mexico's justice system.

"Today the Supreme Court is freeing the guilty, only respecting their rights, while those of the victims have been thrown under the Arc de Triomphe (in Paris)," said Isabel Miranda de Wallace, a respected rights activist.

Still, Wednesday's ruling appeared to draw a line under the long-standing rift between France and Mexico over Cassez.

"Today we can say that between France and Mexico we have the best relations that can be established," French President Francois Hollande said on television after the ruling.

The case hung over former Mexican President Felipe Calderon, who staked his reputation on battling organized crime but ended up presiding over a sharp rise in gang-related violence.

Cassez's release could even pave the way for her to seek law suits against Calderon aides who oversaw her arrest.

"There are various authorities who were involved, and I'm sure all of them, I repeat all of them, now face the possibility of facing proceedings," said Senator Arturo Zamora, a member of the ruling Institutional Revolutionary Party, or PRI.

The departure of Cassez relieves new President Enrique Pena Nieto of a diplomatic headache. He took office in December, returning the PRI to power at the expense of Calderon's conservative National Action Party (PAN).

The PAN, meanwhile, condemned Cassez's release, and some of Calderon's prominent allies could barely contain their anger.

"All we need now is for them to line up outside the exit of the prison shouting long live the new Joan of Arc," Calderon's former labor minister, Javier Lozano, wrote on Twitter shortly after the court announced its decision.

Europe May Be the Last Superpower (Don?t Laugh!)

?A decade of war is now ending,? President Obama declared on Monday. Maybe that's true in America, but it isn't true anywhere else. Extremists are still plotting acts of terror. Authoritarian and autocratic regimes are still using violence to preserve their power. The United States can step back from international conflicts, but that won't make them disappear.

Fortunately, there is another power that shares our economic and political values, that possesses sophisticated military technology, and is also very interested in stopping the progress of fanatical movements, especially in North Africa and the Middle East. That power is ? Europe.

Don't laugh! I realize that even a year ago that statement would have seemed absurd. I certainly couldn?t have written it in the immediate aftermath of the 2011 Libya operation, during which France, Britain, and a dozen other states were barely able to sustain a brief war, involving no ground troops, against a poorly armed and unpopular regime. Unverified reports at the time alleged that the French ran out of bombs and were dropping lumps of concrete. Without the intelligence and coordination provided by American warships, airplanes, and the CIA, the French planes wouldn't even have known where to drop them.

Yet here we are in 2013, watching the French air force and troops come to the aid of the formerly democratic government of Mali, which is fighting for its life against a fanatical Islamist insurgency. Furthermore, this French intervention has (so far) broad national support. Although there have been public criticisms of the operation's logistics, preparation, and ultimate goals, almost no one in France questions the need for intervention. Hardly anyone is even asking "Why France?" ????

The French have a special, post-colonial sentiment for Francophone Africa (and, according to a French friend, for Malian music) and have intervened there militarily more than 40 times since 1960. But the context of this intervention is different from many previous ones. The aim is not (or not entirely) to prop up a pro-French puppet regime but to block the progress of al-Qaida in the Maghreb, the brutal organization that fuels the Malian insurgency and took hostages at an Algerian gas complex last week.

In other words, the French are in Mali fighting an international terrorist organization with the potential to inflict damage across North Africa and perhaps beyond. Not long ago, this sort of international terrorist organization used to inspire emergency planning sessions at the Pentagon. Now the French have trouble getting Washington to pay attention at all. Some U.S. transport planes recently helped ferry French soldiers to the region but, according to Le Figaro, the Americans at first asked the French to pay for the service??a demand without precedent??before wearily agreeing to help.

But other Europeans are offering money and soldiers. The European Union has authorized funding to train African troops who will assist?and it does have more experience than you think. European Union forces, operating far beneath the publicity radar, attacked pirate bases on the Somali coast last spring?successfully. "They destroyed our equipment to ashes," a man described as a ?pirate commander? told the Associated Press. All told, the European Union has intervened militarily in more than two dozen conflicts. Not quite as much as the French since 1960, but getting there.

A number of obstacles must be overcome before the EU could become the world's policeman. Although combined European military does make the EU the world?s second largest military power, it still isn?t enough for any kind of sustained conflict. Some Europeans, most notably the Germans, would have to overcome their post?Second World War abhorrence of soldiers. Other Europeans, most notably the British, would have to be made to believe, as others have concluded, that Americans just aren't that interested in NATO anymore. An added complication emerged this week when British Prime Minister David Cameron announced his intention to renegotiate his country's relationship with the European Union. However it unfolds, this process is unlikely to be conducive to the development of a common European foreign and defense policy.

These are big obstacles. But what's the alternative? If America is to enjoy "peace in our time"?an expression now deployed by both Barack Obama and Neville Chamberlain?while the rest of the world remains at war, then someone else will fill the vacuum. A glance at the other candidates?China, Russia, or perhaps Qatar or another Gulf state?ought to make us all stop giggling about cheese-eating surrender monkeys and start offering logistical and moral support. Europe may not be the best superpower. But it's the only one we've got.

There is no more iconic image in biology than that of DNA's double-stranded helix, which coils and supercoils on itself to form dense chromosomes.

But a quite different, square-shaped type of DNA structure can easily be created in the laboratory by the folding of synthetic DNA strands rich in guanine, one of the building blocks of DNA. Scientists have long believed that these so-called 'G-quadruplex structures' may occasionally form in the DNA of living cells. A G-quadruplex comprises four guanines from different places along a G-rich strand held together by a special type of hydrogen bonding to form a compact square structure that interrupts the DNA helix.

In a paper published online today in Nature Chemistry, researchers led by Shankar Balasubramanian at the University of Cambridge, UK, provide strong evidence that G-quadruplexes do occur in cells ? and that these unusual structures may have important biological functions.

Protecting the chromosome
The protective tips of chromosomal DNA, known as telomeres, are rich in guanine and so are likely candidates for G-quadruplex structures. In fact, studies in cancer cells have shown that small molecules that bind and stabilize G-quadruplex structures cause DNA damage at telomeres, supporting the argument.

After trawling through human genome data in search of other guanine-rich sequences, some scientists have suggested that quadruplexes could also be created in other areas of the genome involved in regulating genes, particularly some cancer-causing genes.

This seems likely to be the case, Balasubramanian and colleagues found. They engineered an antibody that binds tightly and specifically to G-quadruplex structures and does not bind to double-stranded helical DNA. When they incubated the antibody with human cells in culture, they found that it bound to many different sites in the chromosomes, only around a quarter of them in telomeres.

?It?s early days, but if we can map exactly where these G-quadruplex structures pop up in the genome, we may learn how better to control genes or other cellular processes that go awry in diseases like cancer,? he says. ?That?s the long-term vision anyway.??
